PlayRole Terms of Service

1. Overview & Acceptance

PlayRole AI (“PlayRole,” “we,” “our,” or “us”) operates our service under the domains: https://play-role.com and https://play-role.ai and its related sub-domains, services, and applications (collectively, the “Service”). By accessing or using the Service in any manner—including browsing, creating characters, or initiating chats—you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”) and by the Privacy Policy. If you do not agree, do not use the Service. We reserve the right to terminate or suspend access to the Service at any time, including in the event of your actual or suspected unauthorized use of the Service or non-compliance with these Terms.

AI generated output in our chat interface is not moderated for accuracy or legality. Content is machine-generated and may be inaccurate, offensive, or unlawful. You use the Service at your own risk (see Section 16).

2. Eligibility (18+ Only)

1. Age Gate. The Service is available exclusively to individuals who are 18 years or older and meet the legal age of majority in their jurisdiction, whichever is higher.
2. No Minors. Accounts discovered to be controlled by, or on behalf of, anyone under 18 will be terminated and associated data removed.
3. Self-Certification. By creating an account you certify that you satisfy the age requirement. We may request proof of age at any time.
4. Parental Responsibility. Parents or guardians who discover unauthorized use by a minor must contact us immediately at support@play-role.com.

3. Changes to These Terms

1. Right to Amend. We may update these Terms at any time in our sole discretion.
2. Advance Notice. For material changes, we will post the revised Terms and provide at least 7 days' notice by in-app banner or email (see Section 17).
3. Continued Use = Acceptance. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
4. Emergency Changes. We may make immediate changes for legal, security, or regulatory reasons; we will notify you as soon as practicable.

5. User Content Guidelines — Images & Visual Media

1. Zero-Tolerance for Child Sexual Material. Any depiction—realistic or fictional—of minors in sexual contexts is permanently banned.
2. Photorealistic Gore & Extreme Violence. Prohibited. Non-photorealistic or stylized depictions (e.g., illustrations) are allowed within reasonable limits as determined at our discretion.
3. Sexual Content. Permitted if content is properly labeled under Section 6.
4. AI-Generated or Edited Media. Clearly disclose if an image was generated or altered by AI when it could be mistaken for genuine photography.
5. Third-Party Rights. Do not upload images that infringe copyrights, trademarks, or privacy rights.

Failure to comply may lead to content removal, account removal, or referral to law enforcement where legally required.

6. Content Labels & Visibility Controls

1. Mandatory Rating. When creating a character or uploading media, you must assign one of the following ratings:
   • SFW (All-Ages) – No explicit sexual or violent content.
   • NSFW (18+) – Sexual or mature content, intense violence, or fetish material.
2. Enforcement. Content that is misclassified may be hidden, re-rated, or removed. Repeated violations can trigger account suspension.
3. Appeals. If you believe your content was improperly removed or reclassified, you may appeal through support on any support platform such as Discord or email.

7. Fair Use and Copyright

Users must respect intellectual property rights when using the Service. While the Service allows for creative expression and fan-generated content, users should be mindful of copyright laws and fair use principles. Content that infringes upon third-party intellectual property rights may be subject to removal. Users retain ownership of their original content submitted to the Service, while granting PlayRole AI necessary licenses to display and process such content for service operation.

When creating characters or scenarios based on existing intellectual properties, users should ensure their use falls within reasonable fair use guidelines. This includes transformative works, parody, or commentary. However, direct copying of substantial portions of copyrighted material, including but not limited to character descriptions, dialogue, or story lines, may constitute copyright infringement and is not permitted on the Service.

8. DMCA Compliance

PlayRole AI complies with the Digital Millennium Copyright Act (DMCA) and responds promptly to notices of alleged copyright infringement. If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please submit a notification pursuant to the DMCA containing the following information:

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing
• Contact information for the complaining party, including name, address, telephone number, and email address
• A statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner
• A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner

Upon receipt of a valid DMCA notice, PlayRole AI will promptly remove or disable access to the allegedly infringing material and notify the relevant user. Users who believe their content was removed in error may submit a counter-notification in accordance with DMCA procedures.

PlayRole AI maintains a policy of terminating user accounts that are repeat infringers of copyright under appropriate circumstances.

9. User Restrictions

• Attempting to bypass or manipulate the Service's security measures, rate limits, or technical restrictions
• Using automated scripts, bots, or other programmatic methods to access or interact with the Service without explicit authorization
• Selling, transferring, or sharing account access with other individuals
• Engaging in activities that could overload or disrupt the Service's servers or networks
• Collecting, harvesting, or storing information about other users without their explicit consent

Violation of these restrictions may result in immediate account suspension or termination, depending on the severity of the violation. PlayRole AI maintains sole discretion in determining what constitutes a violation of these restrictions and the appropriate response to such violations.

Users found to be engaging in restricted activities may also face permanent IP bans, loss of access to previously created content, and forfeiture of any associated premium features or benefits without refund.

10. Account Restrictions and Termination

PlayRole AI reserves the right to suspend or terminate user accounts that violate these Terms of Service, engage in abusive behavior, or otherwise compromise the integrity of the Service. This includes, but is not limited to, accounts involved in harassment, spam, unauthorized commercial activities, or systematic abuse of the platform's features.

Users whose accounts are terminated for violations may be permanently banned from creating new accounts or accessing the Service. Any attempt to circumvent account restrictions through the creation of alternative accounts or other means will result in immediate termination of those accounts and possible legal action.

Additionally, PlayRole AI may restrict or limit certain account features or capabilities based on user behavior, account history, or platform requirements. These restrictions may be temporary or permanent, depending on the nature and severity of the violations.

11. Payment, Subscription & Refund Terms

11.1 Billing Cycles & Renewals

Paid plans are billed in advance on the cadence you select at checkout (e.g., monthly or annually). Unless you cancel before the end of the current billing cycle, your plan will automatically renew for a new term of identical length at the then-current price.

11.2 Cancellations

You may cancel a paid plan at any time from your account settings. Cancellation stops future renewal charges but does not retroactively refund payments already processed.

11.3 No Refunds on Consumed Digital Goods

Because PlayRole credits and premium features are delivered instantly and irrevocably, all sales are final once the digital goods have been credited to your account. Refunds are issued only where required by law or at our sole discretion in extraordinary circumstances.

11.4 Taxes

Prices are exclusive of all applicable taxes, duties, or levies. You are responsible for any such amounts that may be due in your jurisdiction.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed under the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.

12.1 Binding Arbitration

Except for claims that qualify for small-claims court, any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by JAMS under its Comprehensive Arbitration Rules. The arbitration will take place in Wilmington, Delaware, or remotely at the arbitrator's discretion.

12.2 Class-Action Waiver

You and PlayRole agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims.

12.3 30-Day Opt-Out

If you do not wish to be bound by Section 12, you must notify us in writing at legal@play-role.com within 30 days of first accepting these Terms; otherwise you waive the right to litigate disputes in court or to participate in a class action.

13. Disclaimers & Limitation of Liability

13.1 "As Is" Service

The Site, the Service, and all AI-generated content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

13.2 No Liability for User Content or AI Output

PlayRole does not control or endorse content created by users or generated by AI models and disclaims all liability arising from such content.

13.3 Cap on Damages

To the fullest extent permitted by law, PlayRole's aggregate liability for any claim related to the Service will not exceed the greater of (a) USD $100 or (b) the total fees you paid to us in the 12 months preceding the event giving rise to the claim. Certain jurisdictions do not allow all of these limitations, so they may not apply to you in whole or in part.

14. License to User-Generated Content

Except for content you designate as private (see Privacy Policy), you grant PlayRole a world-wide, non-exclusive, royalty-free, sub-licensable, and transferable license to host, store, reproduce, modify, transmit, display, publish, and create derivative works of your content solely for the purpose of operating, improving, and promoting the Service. This license survives account closure to the extent necessary for archival, backup, or legal compliance.

15. Privacy Policy Incorporation

Our collection and use of personal information are described in the PlayRole Privacy Policy. The Privacy Policy forms part of these Terms. By using the Service, you consent to the handling of your data in accordance with that policy.

16. AI Content Disclaimer

AI outputs may be inaccurate, offensive, or illegal and are generated without human review. You acknowledge that you access such content at your own risk and agree to evaluate its accuracy and legality independently before relying on it.

17. Notice of Material Changes

We will provide at least 7 days' advance notice—via email or prominent in-app banner—for changes to these Terms that materially affect your rights or obligations. Continued use of the Service after the notice period constitutes acceptance of the updated Terms.

18. Indemnification

You agree to defend, indemnify, and hold harmless PlayRole, its affiliates, directors, officers, employees, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

1. Your access to or use of the Service;
2. Your violation of these Terms or any applicable law or regulation;
3. Your User Content, including any allegation that such content infringes, misappropriates, or otherwise violates the intellectual-property, privacy, or other rights of a third party;
4. Any dispute between you and another user of the Service.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

19. Force Majeure

PlayRole will not be liable for any delay or failure to perform its obligations under these Terms if the delay or failure results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, power or Internet service interruptions, supply-chain failures, governmental actions, or the unavailability of third-party platforms or AI providers. Performance will resume as soon as reasonably practicable once the force-majeure event concludes.

20. Assignment

PlayRole may assign or transfer these Terms, in whole or in part, without notice—for example, in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign, delegate, or otherwise transfer your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this section is null and void.

21. Survival

Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability (specifically Sections 7, 12, 13, 14, 18, 21, 22 and 23).

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The failure of PlayRole to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

23. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by PlayRole on the Service, constitute the entire agreement between you and PlayRole concerning your use of the Service. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and PlayRole with respect to the Service.
